Genetic-based Discrimination occurs if someone is treated differently than others based on the results of genetic testing. In the workplace, the issue revolves around insurance coverage when employers or insurance companies seek to avoid covering an individual based on genetic markers that might indicate an increased risk for developing a medical disorder.

Federal and state law protect against genetic-based discrimination, specifically the Genetic Information Nondiscrimination Act (GINA). The Act prevents health insurers from using genetic information to deny or change healthcare coverage based on genetic information as well as prevents employers from using genetic information when making decisions regarding hiring, promotion, or other employment terms.
