What is a Gag Clause?
A gag clause is a contractual obligation that prohibits an employee from discussing critical or sensitive information about their work, employer, or coworkers. Gag clauses are often used to protect proprietary information and a company’s competitive advantage and reputation. They are more general than a non-disclosure agreement (NDA), which tends to address specific issues and is separate from a main employee contract.
